When the registrar determines that a title contains an error, a defect, or is incomplete, he or she issues a demand. If you believe the demand has no legal basis, there is a procedure for bringing the matter before the courts—called a “challenge.”
The registry office official himself refers the matter to the Public Records Court. You, as the applicant, present your interpretation; the registry office explains the grounds for the refusal. The judge decides.
Previously, this procedure applied only to the Real Estate Registry. The new Code of Rules of the TJRJ has also extended it to Notary Offices—so questions regarding the drafting of deeds can also be referred to a judge.
